New Jersey Laws Regarding Visitation Rights

In the state of New Jersey, parents are allowed to create their own visitation schedules and plans. It is important to examine each parent’s schedule and availability to determine a schedule that will best meet the child’s needs, as well as provide maximum time with each parent. As long as the schedule is deemed in the child’s best interests, the court will allow it to become effective. However, if the parents are unable to come to a mutual agreement, the court will step in.

Visitation Schedules Should Contain the Following Items:

  • A residential schedule
  • A vacation schedule
  • A holiday schedule

A residential schedule outlines the specific days and times the child will spend with each parent. On the other hand, a vacation schedule outlines the extended time the child can have with each parent during school breaks and personal vacation time. Parents must also include plans for holidays and other special occasions, which may include birthdays, religious holidays, and other important events.

Should the parents be unable to come to an agreement regarding these three areas, the court will impose a set visitation schedule. If there is a concern about the safety of the child, such as incidents of domestic violence by one parent, the court may order supervised visitation times and modified schedules.
