How Child Support is Calculated in New Jersey

Child support in New Jersey is determined using standardized formulas based on both parents’ combined net incomes. These calculations aim to replicate what parents would typically spend on children if they were living together.

Calculation Process

  1. Income Determination: First, each parent’s gross income is calculated, including wages, bonuses, capital gains, interest, dividends, government benefits, and even gambling winnings.
  2. Net Income: Taxes and mandatory deductions are subtracted to determine net income.
  3. Parenting Time Factor: The amount of time a child spends with each parent affects which formula applies:
    • For non-custodial parents with minimal overnight parenting time, calculations use Appendix IX-F
    • For shared parenting arrangements (28-50% of overnights), calculations follow Appendix IX-D
  4. Judicial Discretion: While these guidelines provide a framework, New Jersey courts make the final determination based on each family’s unique circumstances.

Child Support Duration and Enforcement

Child support typically ends when a child turns 19, or 18 if they’ve completed high school. In special circumstances, courts may extend support beyond these ages.

If you’re not receiving court-ordered payments, legal enforcement options include wage garnishment, property liens, and license suspension. Our New Jersey child support attorneys can guide you through this process.
